Privacy Policy

These Terms of Use ("App Terms") govern your access to and use of the iLovePDF application made available within ChatGPT (the "App").

The App is provided by ILOVEPDF, S.L., a company incorporated under the laws of Spain, with registered address at C/ Sabino de Arana 60, Local 2, 08028 Barcelona, Spain, and tax identification number B66921552 ("iLovePDF", "we", "us" or "our").

By using the App, you acknowledge that you have read, understood and agreed to these App Terms.

1. Scope

These App Terms apply exclusively to the use of the iLovePDF App within ChatGPT and to requests sent from ChatGPT to iLovePDF through the App's technical integration.

The App allows users to request supported document-processing operations from within ChatGPT, including operations involving PDF and other supported document formats.

The App communicates with iLovePDF services through a Model Context Protocol ("MCP") integration operated by iLovePDF.

These App Terms supplement the general iLovePDF Terms and Conditions and Privacy Policy. Where there is a conflict concerning the specific operation of the App within ChatGPT, these App Terms shall prevail. For matters relating to personal data protection, the iLovePDF Privacy Policy shall prevail.

2. Relationship with ChatGPT and OpenAI

The App is made available through ChatGPT, a service operated by OpenAI.

iLovePDF and OpenAI are separate and independent entities. OpenAI does not provide the document-processing services performed by iLovePDF, and iLovePDF does not operate ChatGPT.

Your use of ChatGPT is separately governed by the terms, policies and privacy practices applicable to your relationship with OpenAI.

When you instruct ChatGPT to use the iLovePDF App, ChatGPT may transmit to iLovePDF the files, file references, instructions and other information necessary to perform the operation you requested.

iLovePDF is responsible only for the functionality and services provided by the iLovePDF App and its underlying iLovePDF infrastructure.

3. Purpose of the App

The App is designed exclusively to perform user-requested document-processing operations.

Depending on the functionality available at the time of use, these operations may include actions such as:

  • compressing documents;
  • converting documents between supported formats;
  • merging or splitting PDF files;
  • organizing, rotating or modifying PDF pages;
  • extracting or transforming document content;
  • applying other document-processing operations expressly supported by the App.

The available tools and functionality may change over time.

The App does not independently decide which private files should be processed. A file should only be transmitted to iLovePDF when processing that file is necessary to perform an operation requested by the user.

4. User Files and Content

You retain all ownership rights in the documents, files, text, images and other content that you submit for processing through the App ("User Content").

iLovePDF does not acquire ownership of your User Content.

You grant iLovePDF a limited, temporary and non-exclusive authorization to access, transmit, reproduce and technically process User Content solely to the extent necessary to perform the document-processing operation requested by you and to return the resulting file or result.

This authorization ends when the processing required to provide the requested service has been completed, subject to the temporary technical retention described below.

You are responsible for ensuring that you have all necessary rights, permissions and lawful bases required to submit and process User Content through the App.

5. Restricted and Sensitive Information

The iLovePDF ChatGPT App is a general-purpose document-processing service and is not designed or intended for the processing of Restricted Data.

You must not intentionally submit through the App documents containing:

  1. payment card information subject to PCI DSS requirements, including complete payment card numbers or card authentication data;
  2. protected health information ("PHI");
  3. government-issued identification numbers or equivalent government identifiers, including social security numbers;
  4. passwords, API keys, authentication tokens, MFA or one-time authentication codes, private cryptographic keys, or other authentication secrets.

You should also avoid submitting documents containing sensitive or special-category personal data unless its processing is lawful, necessary for the requested operation, and permitted under all applicable requirements.

The App does not request these categories of information as inputs to provide its document-processing functionality.

If a document contains information that is not necessary for the requested processing operation, you should remove or redact that information before submitting the document.

6. Data Received by the App

The App is designed to receive only the information reasonably necessary to perform the document-processing operation requested by the user.

Depending on the requested operation, this may include:

  • the file or files explicitly selected for processing;
  • file names;
  • file format or MIME type;
  • file size;
  • the document-processing operation requested by the user;
  • parameters necessary to perform that operation;
  • temporary technical identifiers necessary to process and return the result.

The App is not intended to request or collect information such as your health information, government identifiers, payment card information, passwords or authentication credentials.

iLovePDF does not require access to your complete ChatGPT conversation history in order to perform document-processing operations. The App is intended to operate only on the instructions, files and other resources transmitted to it for the specific requested operation.

7. File Processing and Retention

Files transmitted to iLovePDF through the App are processed automatically for the purpose of completing the document-processing operation requested by the user.

Files transmitted between the user, ChatGPT and iLovePDF are protected in transit using secure encrypted connections where supported by the relevant systems.

Files temporarily stored on iLovePDF infrastructure for online processing are automatically deleted from iLovePDF servers within two hours, unless a different retention period is expressly communicated to the user for a specific functionality.

iLovePDF does not use the contents of files submitted through the App for purposes unrelated to providing, securing or maintaining the requested document-processing service.

8. Data Minimization

The App is intended to process only information necessary to fulfill the user's request.

iLovePDF may use limited technical information where necessary to:

  • execute the requested processing operation;
  • deliver the resulting document;
  • prevent fraud or abuse;
  • maintain the security and reliability of the service;
  • diagnose technical failures;
  • comply with legal obligations.

The App should not expose internal diagnostic information, authentication secrets, infrastructure information or unrelated personal information to the user where that information is not necessary to provide the requested result.

9. User Responsibilities

You agree to use the App in good faith and only for lawful purposes.

You must not use the App to:

  1. process content that you do not have the right or authorization to process;
  2. violate intellectual property, privacy, confidentiality, image, publicity or other rights belonging to another person;
  3. process documents in violation of applicable data protection laws;
  4. distribute malware, malicious code or files intended to compromise the App, iLovePDF, ChatGPT, OpenAI or third-party systems;
  5. attempt to gain unauthorized access to iLovePDF systems or infrastructure;
  6. circumvent security mechanisms, file-size restrictions, usage limits or other technical restrictions;
  7. use automated mechanisms to generate abusive or unreasonable volumes of processing requests;
  8. reverse engineer, interfere with or attempt to extract non-public components of the App or its underlying services;
  9. use the App to commit fraud or any unlawful activity;
  10. knowingly submit Restricted Data described in Section 5.

We may refuse to process a request or restrict access to the App where necessary to protect users, iLovePDF, OpenAI, third parties or the integrity and security of the service.

10. Intellectual Property

The App, the underlying iLovePDF software, technologies, interfaces, trademarks, designs, documentation and other intellectual property associated with the iLovePDF services remain the exclusive property of iLovePDF or its licensors.

Subject to compliance with these App Terms, iLovePDF grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to use the App for its intended purpose.

Nothing in these App Terms transfers ownership of any iLovePDF intellectual property to you. The foregoing does not affect your ownership of User Content.

11. Availability and Changes

The App is provided on an "as is" and "as available" basis.

We may add, remove, modify or discontinue App functionalities when reasonably necessary, including because of technical changes, security requirements, changes to iLovePDF services, changes to ChatGPT or the OpenAI platform, legal or regulatory requirements, or modifications to third-party platform requirements.

We do not guarantee that every iLovePDF functionality available on the iLovePDF website, desktop applications, mobile applications or other iLovePDF products will also be available through the ChatGPT App.

We also cannot guarantee that ChatGPT or OpenAI will make the App available at all times.

12. Third-Party Platform Availability

Because the App operates within a third-party platform, some functionality depends on systems controlled by OpenAI.

iLovePDF is not responsible for interruptions, restrictions, modifications or failures caused exclusively by ChatGPT, OpenAI or other systems outside iLovePDF's reasonable control.

Likewise, OpenAI is not responsible for the document-processing services provided by iLovePDF.

13. Fees and Subscriptions

The App does not itself provide a mechanism for purchasing digital subscriptions, credits or paid iLovePDF services within ChatGPT.

Where access to a particular functionality depends on an existing iLovePDF subscription or account, any such subscription must be obtained and managed through the applicable iLovePDF channels and is subject to the applicable iLovePDF Terms and Conditions.

The functionality available through the App may differ depending on technical or usage restrictions applicable to the service.

14. Processing Results

Although iLovePDF takes reasonable measures to provide reliable document processing, document transformations may result in differences in formatting, layout, fonts, images, metadata, document structure or other characteristics.

You are responsible for reviewing processed documents before relying upon, distributing, publishing or otherwise using them.

To the maximum extent permitted by applicable law, iLovePDF does not guarantee that a processed document will be suitable for a particular legal, regulatory, archival, technical or professional purpose.

You should retain a copy of important original files before performing document transformations.

15. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, the App and its functionality are provided without warranties beyond those that cannot lawfully be excluded.

iLovePDF does not warrant that the App will:

  • be uninterrupted or permanently available;
  • be free from every error or technical defect;
  • be compatible with every file or document;
  • preserve every characteristic of the original document;
  • meet every particular purpose or requirement of the user.

To the maximum extent permitted by applicable law, iLovePDF shall not be liable for indirect, incidental, consequential or similar damages arising from the use of or inability to use the App.

Nothing in these App Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.

16. Suspension and Termination

iLovePDF may temporarily or permanently restrict access to the App where reasonably necessary because these App Terms have been violated, the App is being used unlawfully or abusively, continued operation creates a security or legal risk, the user attempts to circumvent service restrictions, the underlying iLovePDF functionality is discontinued, or continued availability is no longer technically or commercially feasible.

OpenAI may independently restrict or remove access to the App in accordance with its own terms and policies.

17. Privacy

The processing of personal data by iLovePDF in connection with the App is governed by the iLovePDF Privacy Policy.

Where iLovePDF processes personal data contained within documents on behalf of an organization or other data controller, the applicable provisions of the iLovePDF Data Processing Agreement may also apply.

The operation of ChatGPT and any processing of information independently performed by OpenAI are governed by OpenAI's applicable terms and privacy policies.

18. Modifications to These App Terms

We may update these App Terms where reasonably necessary to reflect changes to the App, iLovePDF services, OpenAI or ChatGPT platform requirements, security practices, applicable laws or regulations, or our contractual obligations.

The current version of these App Terms will be made available through the location designated for the App.

Where required by applicable law, users will be informed of material changes before those changes take effect.

19. Governing Law and Jurisdiction

These App Terms shall be governed by Spanish law.

Where the user is acting in a professional or business capacity, disputes relating to these App Terms shall be subject to the Courts and Tribunals of Barcelona, Spain, unless mandatory applicable law provides otherwise.

If you are acting as a consumer, nothing in these App Terms affects any mandatory consumer rights or jurisdictional protections available to you under applicable law.

21. Entire Agreement for the App

These App Terms constitute the specific terms governing use of the iLovePDF ChatGPT App.

They should be read together with the iLovePDF Terms and Conditions and iLovePDF Privacy Policy.

In the event of a conflict:

  1. the iLovePDF Privacy Policy shall prevail with respect to personal data protection matters;
  2. these App Terms shall prevail with respect to matters specifically concerning use of the iLovePDF App within ChatGPT; and
  3. the general iLovePDF Terms and Conditions shall apply to all other matters concerning the underlying iLovePDF services.
